GENERAL TERMS AND CONDITIONS OF SALE COBALT XRON®
1. Introduction
These General Terms and Conditions (GTC) define the terms and conditions for booking and using the services offered by Cobalt XRON®.
2. Booking
Reservations can be made online via our website/application or by telephone. To make a reservation, the customer must provide accurate and truthful information. Reservations are confirmed once payment has been made and availability has been confirmed by Cobalt XRON®.
3. Prices and payment
Prices for electric motocross activities are shown on our website and may vary depending on the duration and options chosen. Payments must be made before the start of the activity, unless otherwise agreed. Payments can be made by credit card, bank transfer or any other payment method accepted by Cobalt XRON®.
4. Cancellation and refund
Cancellations must be notified to Cobalt XRON® at least 72 hours before the date of the activity. Cobalt XRON® reserves the right to charge a cancellation fee if the specified deadline is not met. Refunds will be made in accordance with our cancellation policy, except in cases of force majeure.
5. Safety and equipment
Participants must follow the safety instructions provided by Cobalt XRON®. Participants must wear appropriate protective equipment, such as helmets, gloves and motocross gear. Cobalt XRON® reserves the right to refuse participation to anyone who fails to comply with safety instructions.
6. Liability
Participants acknowledge the risks associated with electric motocross and release Cobalt XRON® from all liability in the event of accident or material damage. Participants are required to take out personal liability insurance to cover any personal injury or damage to property.
7. Modification or cancellation by Cobalt XRON®.
Cobalt XRON® reserves the right to modify or cancel a reservation in the event of adverse weather conditions, technical problems or any other unforeseeable factor. In the event of cancellation by Cobalt XRON®, participants will receive a full refund or may postpone their reservation.
8. Applicable law and settlement of disputes
Any dispute arising from these GTC shall be governed by the laws in force in Switzerland. In the event of a dispute, the parties agree to seek an amicable solution before taking legal action.
9. Modification of GTC
Cobalt XRON® reserves the right to modify these terms and conditions at any time. Customers will be informed of any modifications before finalizing their reservation.

Cobalt XRON® Application Terms and Conditions CONFIDENTIALITY COMMITMENT AND DATA COLLECTION

GENERAL CONDITIONS OF PARTICIPATION
Any person participating in the activities of Cobalt Project SA is supposed to be in good health, physically able to participate without endangering themselves or others.
All participants must have mastery of two-wheeled vehicles.
The participant agrees to adopt a sportive, considerate, and fair-play behavior.
Individuals deemed a risk to themselves or others (intoxication, violence, bad behavior, or non-compliance with safety rules) may be denied entry to the circuit or may be expelled without any refund being possible.
To ensure the safety of all, Cobalt Project SA reserves the right to test certain drivers for intoxication. If the test proves to be above 0.8 g/°°°, the visitor will be banned from the circuit without possible refund.
The visitor may only participate in activities after having received oral safety instructions from an operator employed by Cobalt Project SA. These instructions pertain to the course, equipment, and behavior on the track.
A sanction ranging from a stop of a few minutes to permanent exclusion from the circuit will be imposed in case of abuse and non-compliance with track instructions, to maintain absolute safety for all participants.
The operator’s instructions must be followed at all times. In case of non-compliance with the rules and safety instructions, access to activities and/or facilities may be denied. In case of violation or non-compliance with the operator’s safety rules, Cobalt Project SA assumes no responsibility for personal damage.
The participant is aware that they are about to evolve on a slippery circuit filled with obstacles. Falls are possible, and from these falls may result sprains, fractures, strains, bruises, and other injuries of this type. The player accepts this risk and releases Cobalt Project SA from any liability in this regard.
The participant is personally responsible for any loss, breakage, or theft of equipment and gear provided by Cobalt Project SA. Any loss, breakage, or theft will be billed directly according to current rates. The participant agrees to settle these fees immediately after the end of the session in which they participated.
The minimum age is 14 years old. At certain events, this may be waived if clearly indicated. The maximum weight allowed per participant is 100 kg.
Only electric motorcycles belonging to Cobalt Project SA can be used to enter the track. Under no circumstances can your own motorcycles, mopeds, or bikes be used unless explicitly announced.
Under no circumstances will a refund be made if the participant arrives late to their session or if they stop the activity prematurely.
If a program change is imposed during the activity due to factors beyond our control, Cobalt Project SA cannot be billed.
Payment equates to an agreement with the content of the activity and an agreement with the general conditions of Cobalt Project SA.
Cobalt Project SA reserves the right to retain payments as compensation in case of cancellation.
CANCELLATION CONDITIONS: Once a reservation is made and confirmed by full or partial payment online, by email, or by phone, it is deemed final and non-refundable in cash. Thus, in case of cancellation or change of the reservation 72 hours before the start of the reserved part, the customer is credited with a voucher equal to the amount paid at the time of reservation. They can then book later using this credit. Below 72 hours, the credit is no longer granted.
The system relies on an IT infrastructure. In case of network failure (computer or electrical), drivers accept that the type of race may be changed. No refund can be demanded in this case.
During their reservation or registration, the participant agrees that images may be taken during the activities. The images can be used for advertising purposes. If a participant does not agree with this, they must explicitly indicate so at the time of registration. The visual material remains the property of Cobalt Project SA.
Cobalt Project SA cannot be held responsible for accidents and/or thefts on and around the sites before, after, or during activities. Cobalt Project SA recommends its clients to take out a temporary extension of their work accident insurance or another complementary insurance for the duration of the activities/event.
In case of necessary cancellation of one of our activities due to force majeure, such as a pandemic, Cobalt Project SA reserves the right to refund clients by means of a voucher of the same amount and with limited validity.
Lost or misplaced personal belongings are kept for 15 days in a trunk at the Cobalt Project SA locker room. After 15 days, Cobalt Project SA reserves the right to donate these effects to charity. Pilots who have forgotten personal belongings are invited to announce themselves by email or phone the day before they plan to come and pick them up. For logistical reasons and given the number of lost or forgotten effects, these cannot be sent by mail.
